Terms of Service — GigsMarket

Read the terms and conditions governing the use of GigsMarket. Understand your rights and obligations as a buyer or seller on our platform.

1. Acceptance of Terms

By accessing or using GigsMarket ("the Platform"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Platform. These terms apply to all users, including buyers, sellers, and visitors.

2. Account Registration

To access certain features, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information.
  • Keep your password confidential and be responsible for all activity under your account.
  • Be at least 18 years of age, or the legal age of majority in your jurisdiction.
  • Not create more than one account without prior written permission from GigsMarket.

3. Seller Terms

3.1 Gigs and Services

  • Sellers must accurately describe their services, including deliverables, timelines, and pricing.
  • All gigs must comply with our Community Standards and applicable laws.
  • Sellers may not offer services that are illegal, fraudulent, or prohibited on the Platform.
  • Sellers are responsible for delivering work that meets the agreed-upon specifications and deadlines.

3.2 Pricing & Fees

  • GigsMarket charges a service fee of 20% on each completed order for standard sellers.
  • Top-rated sellers may qualify for reduced fees based on performance metrics.
  • Sellers set their own prices and are responsible for any applicable taxes.
  • Attempting to circumvent the Platform's fee structure (e.g., accepting payment outside GigsMarket) is strictly prohibited.

3.3 Withdrawals

  • Funds from completed orders are available for withdrawal after a 14-day clearing period (7 days for top-rated sellers).
  • Withdrawals can be made via bank transfer, PayPal, or Payoneer.
  • Minimum withdrawal amount is $20 for bank transfers and $5 for PayPal/Payoneer.

4. Buyer Terms

4.1 Ordering

  • By placing an order, you agree to pay the listed price plus any applicable taxes.
  • Payment is charged at the time of order placement and held securely by GigsMarket.
  • Buyers must provide clear and complete requirements for their order.

4.2 Revisions

  • Sellers are required to provide the number of revisions specified in their gig package.
  • Revision requests must be reasonable and within the scope of the original order requirements.
  • Additional revisions beyond the included amount may be purchased separately.

5. Payments & Billing

  • All transactions on the Platform are processed in US Dollars (USD) unless otherwise stated.
  • GigsMarket uses PCI-compliant third-party payment processors to handle all financial transactions.
  • Buyers are responsible for any currency conversion fees or international transaction fees charged by their bank.
  • Funds are released to sellers when the buyer marks the order as complete, or automatically 3 days after delivery (if no dispute is raised).

6. Cancellations & Refunds

  • Orders may be cancelled before delivery for a full refund.
  • After delivery, refunds are handled through our Resolution Center on a case-by-case basis.
  • Sellers may cancel an order if the buyer's requirements are unreasonable or outside the scope of the agreed gig.
  • Excessive cancellations by either party may result in account restriction.

7. Disputes & Resolution

If a dispute arises between a buyer and seller, both parties are encouraged to resolve it amicably through the Platform's messaging system. If resolution cannot be reached, either party may escalate the dispute to GigsMarket's Resolution Center. Our team will review the case and make a determination based on evidence provided by both parties. GigsMarket's decision is final.

8. Intellectual Property

  • Buyer Content: Buyers retain all rights to any materials they provide to sellers for use in orders.
  • Delivered Work: Upon full payment and order completion, ownership of delivered work transfers to the buyer, unless otherwise agreed.
  • Seller Portfolio: Sellers may display completed work in their portfolio unless the buyer requests otherwise.
  • Platform Content: All GigsMarket branding, design, code, and content is owned by GigsMarket Inc.

9. Prohibited Conduct

Users may not:

  • Violate any applicable laws or regulations.
  • Infringe on the intellectual property rights of others.
  • Post false, misleading, or fraudulent content.
  • Harass, threaten, or discriminate against other users.
  • Use automated means (bots, scrapers) to access the Platform without permission.
  • Attempt to manipulate the rating or review system.
  • Share contact information or solicit off-platform transactions before an order is placed.

10. Account Suspension & Termination

GigsMarket reserves the right to suspend or terminate accounts that violate these Terms of Service or our Community Standards. Users may appeal suspension decisions by contacting our support team. Upon termination, users must cease all use of the Platform. Outstanding payments will be processed according to our payment terms.

11. Limitation of Liability

GigsMarket provides a platform for buyers and sellers to connect and transact. We are not a party to any transaction between users and are not responsible for the quality, safety, or legality of services provided. To the fullest extent permitted by law, GigsMarket shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Platform.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Material changes will be communicated via email or platform notification at least 30 days before they take effect. Continued use of the Platform after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of San Francisco County, California.
